Appeal for Clarification and Fairness in Labour Registration Fees

Respected Sir,

I recently became aware of the labour registration requirements and associated fees as per notifications issued by your department. While I have no objection to paying these fees, which contribute to the revenue of the Government of Sikkim, I would like to raise a few concerns on behalf of myself and others in the service industry, for the department’s kind clarification before the payment of these fees.

 

Firstly, it is unclear why these fees are being levied retrospectively from the date of registration of the enterprise. For instance, some organizations registered as early as the year 2000 are now being asked to pay fees, including penalties, for the period between 2000 and 2024—a span of 24 years. This retroactive application appears unfair.

 

Secondly, when we apply for a trade license with the Gangtok Municipal Corporation (GMC), why is there no requirement to submit a Labour Registration certificate at the time of registration? This process is already in place for clearances from departments such as Health, Fire, and FCS. If such a requirement were implemented during the initial registration, it would allow enterprises to complete their documentation at that time, avoiding the imposition of penal fees later on.

 

Thirdly, there is a significant lack of awareness within the business community regarding the labour registration fees. Before enforcing these charges, it would be beneficial for the department to conduct an awareness campaign to educate the public. This would help prevent what currently seems like an arbitrary imposition of high fees.

 

Finally, I request the department to consider setting a cut-off year, from which the fees will be levied going forward. This will allow enterprises to plan for these charges without the burden of retroactive payments, which would be particularly difficult for the service industry, already struggling due to various natural and man-made disasters.
