Timely Justice

 

•           Timeline of delivery of justice fixed: Our endeavour will be to ensure justice within 3 years

•           FIR registered within 3 days on filing complaint through electronic medium

•           Investigation report in sexual harassment will have to be sent within 7 days.

•           Charges will be framed within 60 days of the first hearing.

•           In case of absence of the proclaimed offenders, trial within 90 days

•           Judgment will have to be given within 45 days of the end of trial in criminal cases.

 

Crimes against women and children

 

•           Priority: Crimes against women and children

•           There are 35 sections related to crimes against women and children, in which about 13 are new provisions and some amendments in the remaining sections

•           Gangrape: 20 years of punishment/life imprisonment

•           Gangrape of a minor: Death sentence/life imprisonment

•           Making false promises/having sexual relations by hiding identity is now a crime

•           Victim's statement will be recorded in front of a woman officer in presence of victim's guardian at her residence

 

Use of technology

 

•           To create the most modern justice system in the world

•           All the modern technologies that will come in the next 50 years will be integrated in it

•           Computerization of the process from police investigation to court

•           Zero FIR, E-FIR, charge sheet will be digital

•           Victim will get information within 90 days

•           In cases where punishment is 7 years or more forensics is mandatory

•           Permission for recording of evidence in investigation

•           Videography of the entire process of police search is mandatory

•           E-statement for rape victim

•           Audio-video recording will be presented in the court.

•           E-appearance: Appearance of witnesses, accused, experts and victims through electronic medium.

 

Promotion of forensics

 

•           Forensics compulsory for all punishable crimes with 7 years or more

•           Promotion of scientific methods in investigation

•           Target to take the conviction rate to 90%

•           Forensics compulsory in all states/union territories

•           Infrastructure in States/Union Territories will be ready in 5 years

•           Creating labs at various places to strengthen forensic infrastructure

 

Mob lynching

 

•           Mob lynching has been defined for the first time

•           Murder/serious offence motivated on the basis of race/caste/community, sex, place of birth, language etc.

•           Provision of 7 years imprisonment for the convict

•           In case of Permanent disability of victim, 10 years of sentence/life

imprisonment to the convict

 

Victim-centric laws

 

•           3 key features of victim-centric laws

-Opportunity for the victim to present his case

-Right to information and

-Right to compensation for loss

•           Institutionalization of filing Zero FIR

•           Now FIR can be filed anywhere

•           Victim has the right to receive a copy of the FIR in free of cost
